Terms
Offer and Acceptance
The execution of the Contract by the Renter constitutes an offer to rent the goods described in the schedule. The offer shall be deemed accepted by The Lessor upon delivery or installation of the goods at the premises described. The Lessor may rescind this Agreement within one calendar month from acceptance subject to repayment of monies paid, unless false or misleading information has been provided by the Renter.
Goods and Ownership
The goods remain the sole property of The Lessor at all times. Nothing in this Agreement constitutes an offer to sell or an option to purchase. The Lessor may substitute goods of the same nature and function subject to availability.
Termination
The Renter must provide not less than seventy-two hours’ notice of termination. The Lessor may terminate without notice in the event of breach, insolvency, execution, or unsoundness of mind. Termination does not affect accrued rights.
Return and Recovery
Upon termination the Renter must return the goods or make them available for collection. Failure to do so will result in liability for recovery costs and outstanding amounts.
Use and Care of Goods
The goods must not be removed from the premises without written consent. The Renter must not create any lien or encumbrance and must keep the goods clean and in good condition.
Maintenance
The Lessor will service the goods and replace faulty parts caused by fair wear and tear, provided the Renter is not in breach of this Agreement.
Loss and Damage
The Renter indemnifies The Lessor against loss or damage other than fair wear and tear.
Cleaning fees
up to $55.00 per appliance may apply if extensive cleaning is required.
Inspection
The Lessor may inspect and test the goods at reasonable times.
Liability
To the extent permitted by law, The Lessor is not liable for loss or damage arising from delivery, installation, or use. Statutory consumer guarantees are not excluded.
Rental Increases
Subject to applicable legislation, rental charges may be increased after twelve months upon notice.
Taxes and Charges
The Renter agrees to pay any additional government charges payable by The Lessor in respect of the goods, to the extent permitted by law.
Default
If payment is overdue by seven days or a breach occurs, The Lessor may repossess the goods and recover costs.
Privacy and Credit Reporting
The Renter consents to the collection and disclosure of personal information in accordance with the Privacy Act 1988 including credit reporting and debt collection purposes.
Payment Authority
By providing credit card details, the Renter authorises The Lessor to debit rental payments, fees, and costs.
